1. About SmmFoxi and These Terms

SmmFoxi (operated by the SmmFoxi team) is a social-media marketing (SMM) platform that lets business and individual buyers order promotion and engagement services delivered through a large, growing global network of verified real people. In these Terms, "we", "us", and "our" mean the SmmFoxi team; "you" means the buyer and account holder.

These Terms of Service ("Terms") form a binding agreement between you and us governing your access to and use of SmmFoxi at https://smmfoxi.com and any related interfaces. By registering, depositing funds, or placing an order, you accept these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility & Account Registration

To use SmmFoxi you must be at least 18 years old and have full legal capacity to enter into contracts. The service is for lawful commercial and personal promotion only.

• You must register with accurate, current information and keep it up to date.
• Where required by law or our risk controls, you agree to complete identity or business verification (KYC) before depositing or ordering.
• You are responsible for all activity under your account and for keeping your credentials secure.
• One person or entity may not operate multiple accounts to abuse promotions, evade limits, or circumvent enforcement.

3. Scope of Services

SmmFoxi offers SMM services across major social platforms — including followers, likes, views, and engagement — fulfilled by real network participants rather than bots.

• Service availability, pricing, minimum and maximum quantities, and delivery speed are shown on the order page and may change at any time.
• Delivery times are estimates that depend on order size, service type, and third-party platform conditions.
• We do not control third-party social platforms and cannot guarantee any specific outcome, ranking, retention, or monetary result.

4. Deposits & Payments

SmmFoxi operates on a prepaid balance: you add funds to your account and spend them on orders.

• Accepted payment methods include cryptocurrency via Cryptomus (USDT / USDC), TON, and bank card. Available methods may vary by region.
• Card payments are processed by third-party payment processors; we do not store full card numbers.
• You are responsible for any network, exchange, or bank fees charged by payment providers.
• Crypto deposits are credited after the required network confirmations; we are not responsible for funds sent to a wrong address or on an unsupported network.
• You must use payment instruments that lawfully belong to you. Fraudulent, disputed, or reversed payments may lead to order cancellation and account suspension.

5. Orders & Service Delivery

• Once an order is placed, the corresponding amount is deducted from your balance and the order enters processing.
• You must provide a correct and public target link or handle. Orders may fail or become non-refundable when the target is private, deleted, incorrect, or changed during delivery.
• Partial delivery may occur due to third-party platform limits; in that case the unfilled quantity is refunded to your balance where applicable.
• We may refuse, cancel, or hold any order suspected of violating these Terms, third-party platform rules, or applicable law.

6. Refund Policy

Because services are fulfilled by real people and depend on third-party platforms, refunds are handled as follows.

Refundable / credited back to balance

• Orders we fail to start.
• The undelivered portion of a partially completed order.
• Duplicate charges caused by a verified system error.

Non-refundable

• Orders already delivered, or in progress, that meet the ordered specification.
• Failures caused by an incorrect, private, or removed target you provided.
• Drops or losses caused by the third-party platform after delivery, beyond any stated refill or guarantee window.
• Change of mind after processing has begun.

Refunds, where due, are credited to your SmmFoxi balance. We do not make absolute promises of results, and a balance refund is the sole remedy for service issues. Chargebacks filed without first contacting support may result in account suspension and forfeiture of remaining balance.

7. Reseller & API Program

SmmFoxi offers a reseller program with a v2 API for approved business customers who resell services to their own clients.

• API access requires an approved account and a valid API key; you are responsible for keeping the key secret and for all activity under it.
• You must not exceed published rate limits, scrape, or use the API to attack, overload, or reverse-engineer the platform.
• As a reseller you set your own prices to your clients but remain fully responsible to us for your balance, compliance, and your clients’ conduct.
• We may suspend API access for abuse, non-payment, or violations, without notice where necessary.

8. Agent / Affiliate Commission

SmmFoxi may offer an agent and affiliate program that pays commission for referred, paying customers.

• Commission rates, eligibility, membership tiers, and payout rules are defined in the program terms shown in your account and may change.
• Commissions earned through fraud, self-referral, fake accounts, or incentivized abuse are void and may be clawed back.
• We may adjust, withhold, or reverse commissions where we reasonably suspect abuse or a reversal of the underlying payment.

9. User Conduct & Prohibited Use

You agree to use SmmFoxi only for lawful purposes. You must not:

• use the service for fraud, money laundering, terrorist financing, or to evade sanctions, taxes, or regulatory obligations;
• buy engagement for illegal, infringing, hateful, sexually exploitative, violent, or otherwise prohibited content;
• promote content that violates a third-party platform’s rules in a way that exposes us to liability;
• lend, sell, rent, or transfer your account, balance, or API key to others;
• use bots, scrapers, or automated abuse against SmmFoxi, bypass risk controls, or attempt to attack, probe, or disrupt our systems;
• harass, threaten, impersonate, or defraud other users, our staff, or third parties;
• reverse-engineer, resell outside the reseller program, or misrepresent the service.

10. User Content & Intellectual Property

• You are solely responsible for the links, handles, text, and materials you submit, and you warrant that you have the right to use them.
• You grant us the limited right to process your order data solely to deliver the service.
• All software, design, text, logos, and the SmmFoxi brand are owned by us or our licensors and protected by intellectual-property law. You receive no ownership and may not copy, frame, or exploit them beyond normal use of the service.

11. Third-Party Platforms & Services

SmmFoxi interacts with third-party social platforms and payment providers that we do not control.

• Your use of any social platform remains subject to that platform’s own terms; you are responsible for compliance.
• We are not liable for changes, outages, account actions, or policy enforcement by third-party platforms.
• Payment, crypto, and network providers operate under their own terms and risk.

12. Disclaimers & Limitation of Liability

To the maximum extent permitted by law, SmmFoxi is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, uninterrupted availability, or any specific promotional result.

• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, goodwill, or data.
• We are not liable for losses caused by network interruptions, third-party platform failures, force majeure, or policy and regulatory changes.
• Our total aggregate liability for any claim is limited to the amount you paid us for the specific order giving rise to the claim in the 12 months before the event.

Some jurisdictions do not allow certain limitations; in that case, the limitations apply to the fullest extent permitted by law.

13. Enforcement, Suspension & Termination

If you violate these Terms or applicable law, we may, at our discretion and proportionate to the issue:

• issue a warning or temporarily limit features;
• hold, cancel, or reverse orders and commissions;
• suspend or permanently terminate your account and forfeit balances obtained through fraud or abuse;
• report unlawful activity to regulators or law enforcement and cooperate with investigations;
• pursue damages and other legal remedies.

14. Changes, Governing Law, Disputes & Contact

• We may update these Terms at any time. Material changes are announced through the platform or by notice; continued use after the effective date constitutes acceptance.
• These Terms are governed by the laws of the platform's operating jurisdiction, and disputes are subject to the competent courts of that jurisdiction, without prejudice to mandatory consumer-protection rights in your country of residence.
• For cross-border users: you are responsible for complying with your local laws and any applicable export-control and sanctions regimes. The service is not offered to sanctioned persons or in embargoed territories.
• If any provision is held invalid, the remaining provisions stay in effect.
